Terms of Service
These Terms of Service („Terms”) govern the use of services provided by WebWiseAI Tomasz Ścierski, NIP number: PL6463009555, REGON number: 527437312 (hereinafter referred to as the „Service Provider” or „Company”) to Users. The services consist of:
1. Sales Octopus WordPress Plugin – A WordPress plugin that provides website auditing, technology detection, pixel tracking analysis, sales funnel management, traffic analysis, user behavior monitoring, integration with advertising platforms, analytics tools configuration, and AI-powered profession classification.
2. Sales Octopus Web Platform – An online platform that provides AI-powered Facebook advertising content generation, market research automation, target audience selection, campaign creation guidance, and campaign performance analysis tools.
3. Subscription-based premium services including AI credits, advanced analytics and reporting, premium support.
The country of sale and business operations is Poland.

II. Definitions
Regulations – this document.
Owner of the Service / Service Provider – WebWiseAI Tomasz Ścierski, NIP number: PL6463009555, REGON number: 527437312, with the above-mentioned contact details.
Sales Octopus WordPress Plugin – the WordPress plugin software provided by the Service Provider, downloadable from salesoctopus.io, which provides website auditing, sales funnel management, traffic analysis, and integration with advertising and analytics platforms.
User – any natural or legal person who accesses, uses, or creates an Account on the Platform or uses the Sales Octopus WordPress Plugin.
Platform – The Sales Octopus web platform operated by the Service Provider at salesoctopus.io that provides AI-powered Facebook advertising tools, market research automation, and campaign management features.
Account – a user account created by a User that allows access to the Platform and Services, identified by a unique email address and containing user profile information, subscription status, AI credits balance, and website audit data.
Subscription – a paid service plan that grants the User access to premium features of the Sales Octopus WordPress Plugin and Platform, including advanced analytics and reporting, AI-powered content generation, premium support, extended audit capabilities and 100,000 AI credits per month.
AI Credits – virtual tokens that allow Users to utilize AI-powered features including website profession classification, Facebook ad content generation, market research automation, target audience analysis, and campaign performance insights. Each AI operation consumes a specific number of credits based on complexity.
Plan Podstawowy – the free service tier that provides basic website auditing capabilities, limited AI credits (1,000 tokens), basic analytics, and standard support.
Free Trial – a 14-day free trial period that can be available to User providing limited access to premium features.
Billing Cycle – a recurring monthly period for collecting subscription fees.
Website Audit – the core service provided by the Service Provider that performs comprehensive analysis of websites including technology detection, pixel tracking analysis, analytics tools detection, and AI-powered profession classification.
Services – the collective term for all features and functionalities provided by the Service Provider, including but not limited to the Sales Octopus WordPress Plugin features, the Sales Octopus Web Platform features, website auditing services, AI-powered content generation, analytics and reporting, and all other services described in these Terms.
Premium Account – a User account that has an active paid subscription providing access to premium features including advanced analytics, extended AI credits (100,000 tokens per month), priority support, and full access to all Services.
Newsletter – electronic communications sent by the Service Provider to Users containing information about Services, updates, promotional offers, and other relevant information related to the Platform and Services.
Service Recipient – any natural or legal person who receives Services from the Service Provider, including Users, Account holders, and any person who accesses or uses the Platform or Services.
III. General terms of use for the Service
These Regulations govern the rules for the use of all the Services operated by the Service Provider.
Use of the Sales Octopus WordPress Plugin, Platform and its functionalities requires acceptance of these Regulations. By creating an Account, installing, or using the Sales Octopus WordPress Plugin, the User agrees to abide by these Regulations.
The User is fully responsible for actions performed under their Account.
The Service Provider reserves the right to modify Platform and Sales Octopus WordPress Plugin functionalities, including any features.
Any content generated by the AI Suggestions is for informational purposes only.
The information provided herein is solely for informational purposes and does not constitute financial, marketing or any other form of professional advice.
Users must independently verify the accuracy and appropriateness of any AI Suggestions generated content before using it.
The Platform or Sales Octopus WordPress Plugin may be temporarily unavailable due to technical reasons, modernization, maintenance, or unforeseen failure. The Service Provider strives to minimize interruptions and will not be held responsible for any unavailability or related issues arising from such circumstances.
In case of violation of these Regulations by the User, the Service Provider may block or restrict the User’s Account. Personal data is processed in accordance with the law, the Privacy Policy, and the Cookie Policy. Any use, data gathering, or dissemination of the information, interface, or materials in the Sales Octopus WordPress Plugin requires prior consent of the Service Owner.
Users are prohibited from engaging in any malicious or harmful activities, including but not limited to: Distributed Denial of Service (DDoS) attacks, attempting to overwhelm the Platform or Sales Octopus WordPress Plugin with excessive traffic or trying to gain access to restricted areas of the Platform or Sales Octopus WordPress Plugin.
IV. Account
Creating an Account requires completing a registration form on the Platforma and accepting these Regulations. The User is responsible for the security of their login and password. Sharing login credentials is prohibited. The Service Provider may remove or block an Account if: it is used for illegal activity, or the User engages in activities that disrupt or may disrupt the Platform’s or Sales Octopus WordPress Plugin operation.
The User may delete their Account at any time by contacting the Service Provider at contact@salesoctopus.io. Account deletion results in the loss of access to Platform and Sales Octopus WordPress Plugin features – even to the premium subscription. Upon Account deletion or blockage, data associated with that Account may be irreversibly removed.
The User agrees to keep their account information (e.g., email address) updated. The Service Provider shall not be liable for loss or damage due to unauthorized account access arising from User negligence. Registration and use of the Platform implies acceptance of these Terms of Service and the Privacy Policy.
Right of Withdrawal: Users expressly waive any and all rights to withdraw from the agreement. By purchasing the Services, Users acknowledge that they are purchasing digital services and content that are immediately delivered upon payment. Users understand that all sales are final and that no withdrawal rights apply to digital services, subscriptions, or any other services provided by the Service Provider.
V. Service Features and Usage Rules
The Service Provider offers the following services:

– Website auditing and technology detection capabilities
– Pixel tracking detection for various advertising platforms
– Analytics tools detection and configuration
– AI-powered profession classification
– Sales funnel creation and management
– Traffic analysis and user behavior monitoring
– Integration with advertising platforms
– Email marketing automation integration
Sales Octopus Web Platform Features:
– AI-powered Facebook advertising content generation
– Automated market research and analysis
– Target audience selection and optimization
– Campaign creation guidance and best practices
– Campaign performance analysis and reporting
– Integration with third-party advertising platforms
Usage Rules and Restrictions:
– Users must provide accurate and valid website URLs for auditing purposes
– AI-generated content is provided for informational purposes only and does not constitute professional advice
– Users are solely responsible for verifying and validating any AI-generated recommendations before implementation
– Platform usage is subject to rate limiting restrictions (10 requests per minute per IP address)
– Users must comply with all applicable advertising platform policies and terms of service
– All data processing activities comply with applicable privacy regulations including GDPR
– Users are prohibited from using the Services for any illegal, harmful, or unauthorized purposes
– Users may not attempt to reverse engineer, decompile, or disassemble the Services
– Users may not use automated systems to access the Services without prior written consent
The User acknowledges that the Owner of the Service is not responsible for the operations performed by all these features and is not responsible for the information and recommendation those features made. The User acknowledges that data sent to Platform or Sales Octopus WordPress Plugin may be sent to supporting artificial intelligence systems, among others, OpenAI. Use of Platform or Sales Octopus WordPress Plugin constitutes acceptance of these terms.
VI. Limitation of Liability
Notwithstanding any damages that User might incur, the entire liability of the Service Provider and any of its affiliates, partners, or suppliers under any provision of these Terms, and User exclusive remedy for all the foregoing, shall be limited to the total amount actually paid by User through the Service or 100 USD if User has not made any purchases through the Service.
To the maximum extent permitted by applicable law, in no event shall the Service Provider or its affiliates, partners, or suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, loss of use, business interruption, personal injury, loss of privacy, or any other pecuniary or non-pecuniary loss) arising out of or in any way related to the use of or inability to use the Service, third-party software, and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms, even if the Service Provider or any affiliate, partner, or supplier has been advised of the possibility of such damages and even if any remedy fails of its essential purpose.
Certain jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to a User. In such jurisdictions, the liability of each party will be limited to the greatest extent permitted by applicable law. The Service Provider is not responsible for the content generated by the AI Suggestions outputs are purely informational. The User is obligated to verify any information generated by the AI Suggestions , particularly in contexts where accuracy or reliability is crucial (e.g., financial advice or marketing campaigns).
VII. Subscription Plans and Pricing
The Service Provider offers the following subscription plans. Please note that the pricing listed below represents “Classic Pricing” and is subject to change. The Service Provider reserves the right to modify prices and billing currencies at any time.
Free Plan :
The Service Provider offers a free tier that includes basic website auditing capabilities, limited AI credits (1,000 tokens per month), basic analytics and reporting, standard email support, and access to basic WordPress plugin features.
Paid Subscription Plans:
a) Free Trial + Monthly Subscription ($27/month):
The Service Provider may offer a 30-day free trial period providing limited access to premium features. No payment is required during the trial period. The trial automatically converts to a paid subscription of $27 per month after the trial period expires unless the User cancels before the trial ends. This plan includes full access to all WordPress plugin features, complete access to the Sales Octopus web platform, 100,000 AI credits per month, advanced analytics and detailed reporting, sales funnel management and conversion tracking, integration with advertising platforms, AI-powered Facebook advertising content generation, market research automation, target audience analysis and optimization, campaign performance insights, and automatic subscription renewal. This plan does NOT include marketing specialist support.
b) Annual Subscription ($228/year):
This plan includes all features from the monthly subscription plus premium marketing specialist support. Premium marketing support includes text-based support and the option to book a call in a calendar with a dedicated human specialist. The response time from the marketing specialist is up to 3 working days. This plan provides the best value and includes priority access to marketing expertise.
c) Quarterly Subscription ($69/quarter):
This plan includes all features from the monthly subscription plus basic marketing specialist support. Basic marketing support includes text-based support only. The response time from the marketing specialist is up to 3 working days.
Marketing Specialist Support Terms:
– No marketing specialist support is provided for the $27/month subscription plan or a free trial period
– Basic marketing specialist support (text-based only) is provided for quarterly and monthly subscription plans
– Premium marketing specialist support (text-based + calendar booking for calls with dedicated human specialist) is provided for the annual subscription plan
– Response time for all marketing specialist support inquiries is up to 3 working days
– Marketing specialist support is available during business hours (9:00–17:00 UTC+2)
– Support is provided in English and Polish languages
Payment & Renewal
Subscriptions renew monthly. Payment methods include credit/debit cards, PayPal, and Stripe. If payment is successful, the User’s subscription remains active, and AI credits are refreshed to 100,000 tokens. If payment fails, the subscription may be placed on hold, blocking premium features while maintaining basic functionality.
VIII. Payment Terms
Use of premium features on the Platform and Sales Octopus WordPress Plugin requires payment. The Service Provider accepts payment through Stripe.
Payment Processing:
– All payments are processed securely through third-party payment processors
– Automatic monthly billing applies to subscription renewals
– Payment failures may result in service suspension or termination
– Users will receive email notifications for all payment transactions
– The Service Provider reserves the right to change payment methods at any time
Discount Codes:
Any discount codes offered by the Service Provider must be applied before finalizing the transaction. Discount codes cannot be redeemed for cash, cannot be transferred, and cannot be used beyond their validity date. The Service Provider reserves the right to modify or cancel discount codes at any time.
Refund Policy:
No refunds are available for subscription fees, AI credits, or any services provided. All sales are final. The Service Provider does not provide refunds for any reason, including but not limited to: dissatisfaction with the service, technical issues, account suspension, or termination. Users acknowledge that by purchasing a subscription, they are purchasing access to digital services and content, and that all payments are non-refundable. No exceptions apply to this policy.
IMPORTANT – Support Usage and Refund Eligibility:
Refunds are NOT available for any User who has an active subscription and has used marketing specialist support services. Using marketing specialist support (including but not limited to: submitting support tickets, engaging in text-based support conversations, booking or attending calls with marketing specialists, or requesting any form of marketing assistance) automatically disqualifies the User from any refund eligibility. By using marketing specialist support services, the User acknowledges that they have consumed professional services and waives any and all rights to request or receive a refund for their subscription fees.
Additional Refund Limitations:
– Users expressly waive any right to chargebacks or payment disputes through their payment provider
– Users acknowledge that the Services are provided „as is” and that the Service Provider makes no warranties regarding the Services
– Users agree that any disputes regarding payments or refunds will be resolved through the dispute resolution procedures outlined in these Terms
– Users understand that AI credits, once purchased or allocated, cannot be refunded or transferred
– Users acknowledge that digital content and services are immediately delivered upon payment and cannot be returned
– Users agree that any technical issues or service interruptions do not constitute grounds for refunds
– Users understand that subscription cancellations do not entitle them to refunds for the current billing period
– Users who have utilized marketing specialist support services are permanently ineligible for refunds regardless of any other circumstances
IX. Dispute Resolution and Complaints

Technical Support:
Users experiencing technical difficulties should contact the Service Provider using the methods above, providing sufficient details to enable identification and resolution of the issue.
Complaint Procedure:
Complaints related to non-performance or improper performance of the Services may be submitted electronically or by registered mail to the Service Provider’s address. Complaints must include the User’s name, email address associated with the Account, and other identifying information.
The Service Provider will review complaints from Premium Account holders within 14 days of receipt, and from other Users within 30 days. The outcome of any complaint review will be communicated to the User via email or phone.
Dispute Resolution:
Any disputes arising from these Terms or the use of the Services shall be resolved through negotiation in good faith. If such negotiation fails, disputes shall be resolved through binding arbitration or in the courts of Poland, as applicable under Polish law.
X. Final provisions
The Service Provider reserves the right to make changes to these Terms and Conditions for important reasons, namely: changes in legal regulations; changes in payment methods or terms or performance of the contract, compliance with legal or regulatory obligations; changes in the scope or form of the provided Electronic Services; addition of new Electronic Services; necessity to counteract unforeseen and direct threats related to the protection of the Online Store, including Electronic Services and Service Recipients/Customers against fraud, malicious software, spam, data breaches, or other cybersecurity threats – to the extent that such changes affect the implementation of the provisions of these Terms and Conditions.
Notification of proposed changes is sent at least 15 days in advance of the effective date of these changes, provided that the change may be implemented without adhering to the 15-day notification period in cases where the Service Provider: (1) is subject to a legal or regulatory obligation that requires the Terms and Conditions to be changed in a manner that prevents adherence to the 15-day notification period; or (2) must exceptionally change its Terms and Conditions to counteract unforeseen and direct threats related to the protection of the Online Store, including Electronic Services and Service Recipients/Customers against fraud, malicious software, spam, data breaches, or other cybersecurity threats. In the last two cases mentioned in the previous sentence, the changes take effect immediately, unless a longer period for implementing the changes is possible or necessary, in which case the Service Provider notifies accordingly.
In the case of continuous contracts (e.g., provision of an Electronic Service – Newsletter), the Service Recipient has the right to terminate the contract with the Service Provider before the end of the notification period regarding the proposed changes. Such termination becomes effective within 15 days from the day of receiving the notification. In the case of entering into a continuous contract, the amended Terms and Conditions bind the Service Recipient if they have been properly notified of the changes in accordance with the notification period before their implementation and have not terminated the contract within this period. Additionally, at any time after receiving the notification of changes, the Service Recipient may accept the introduced changes and thereby waive the continuation of the notification period. In the case of entering into a contract of a different nature than continuous contracts, the changes to the Terms and Conditions will not in any way violate the acquired rights of the Service Recipient before the effective date of the changes to the Terms and Conditions, in particular, the changes to the Terms and Conditions will not affect orders already placed or submitted and concluded, executed, or performed Sales Agreements.
In the event that a change to the Terms and Conditions results in the introduction of any new fees or the increase of existing ones, the consumer has no right to withdraw from the contract. Users acknowledge that fee changes are part of the service terms and that continued use of the service constitutes acceptance of such changes.
Matters not regulated in these Terms and Conditions are governed by the generally applicable provisions of Polish law, in particular: the Civil Code; the Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws 2002 No. 144, item 1204, as amended); the Consumer Rights Act; and other relevant provisions of generally applicable law. In the event of any legal proceedings, such proceedings shall take place at the residence of the Service Owner, i.e., Poland.
NO WITHDRAWAL RIGHTS APPLY
Users acknowledge and agree that no withdrawal rights apply to any services, subscriptions, or products provided by the Service Provider. All sales are final and non-refundable. By using the Services, Users expressly waive any and all rights to withdraw from any agreement or contract.
